INCIDENTS OF PIRACY IN WEST AFRICA<\/h3>\n

Reports of incidents of piracy and the capture of sailors have been constantly in the foreground in recent years. Especially in the regions of West Africa, with the focus on the maritime area of the Gulf of Guinea, numerous pirate raids have taken place at the expense of commercial ships with the aim of seizing them, capturing sailors and officers and using them as hostages for exchange for heavy ransoms.<\/p>\n

LABOR ACCIDENT<\/h3>\n

As decided by the Courts of Piraeus, the conditions under which the physical and mental injuries suffered by seafarers – victims of piracy and hostages, establish the right to compensation, understood as “LABOR ACCIDENT”. Therefore, seafarers who happen to have been victims of piracy are entitled to the labor accident compensation provided for in the law and maritime labor contracts, either because of their injury during the pirate attack or because of their hostage-captivity by the pirates.<\/p>\n

MORAL DAMAGE – MENTAL PAIN<\/h3>\n

In addition to the legal or contractual labor compensation, those sailors who suffered physical damage due to a pirate attack are also entitled to MONETARY COMPENSATION due to their moral damage for the pain and suffering they were subjected to.<\/p>\n

Similarly, the families of seafarers who lost their lives during a piracy attack or fatal hostage situation are entitled to substantial monetary compensation for their mental anguish. This additional claim for damages should be carefully based on actual facts of breach of security regulations and wrongful acts or omissions that led to (otherwise did not prevent) the piracy attack against the ship.<\/p>\n

\u00a0In the past, our office has repeatedly defended the rights of seafarers – victims of pirate attacks – and their relatives, who suffered injuries during a pirate attack, were in a state of captivity and ended up in a successful release, as well as in cases of fatal hostages.<\/p>\n
